1. Website publisher

The website cm4dn.com (the “Website”) is published by the owner of the apartments presented on it (the “publisher”).

The publisher can be contacted by email at: contact@cm4dn.com

The publisher is not a real estate agency. The apartments presented on the Website are owned by the publisher and managed with the help of a local property manager.

3. Purpose of the Website

The Website presents furnished apartments located in the Nimman area of Chiang Mai, Thailand, available for monthly and long-term rental. It allows visitors to view the apartments, check availability, contact the publisher and sign up to be notified of new availabilities.

Prices, availabilities, descriptions, photos and videos are provided for information purposes only and may change at any time. They do not constitute a binding offer. A booking is only confirmed once the publisher has sent a written summary of the booking terms (price, dates, what is and is not included) and the booking advance has been received, as described in the FAQ and the Terms of Service.

4. Intellectual property

All content on the Website, including texts, photos, videos, logos, graphics and layout, is the property of the publisher or is used with permission, and is protected by applicable intellectual property laws.

Any reproduction, distribution, modification or reuse of all or part of this content, by any means, without the prior written consent of the publisher is prohibited.

Third-party names and trademarks mentioned on the Website (such as Airbnb, Google, YouTube or Lenovo) belong to their respective owners. Their mention does not imply any partnership or endorsement.

5. Guest reviews

The testimonials published on the Website come from reviews left by guests on Airbnb. They are displayed with the guest’s first name and country only, together with a link to the original review. Reviews from guests who were personally known to the publisher before their stay are not published on the Website.

Any guest who wishes to have their review removed from the Website can request it at contact@cm4dn.com.

6. Limitation of liability

The publisher makes reasonable efforts to keep the information on the Website accurate and up to date, but cannot guarantee that it is complete, accurate or free of errors at all times. The publisher cannot be held liable for any damage resulting from the use of the Website, from its temporary unavailability, or from any error or omission in its content.

Information about the buildings, the neighbourhood and nearby facilities (swimming pools, gyms, shops, restaurants, coworking spaces, etc.) is provided in good faith. These facilities are operated by third parties and are outside the publisher’s control.

The Website contains links to third-party websites, including Airbnb, social networks, Google Maps and invest-thailand.com. The publisher has no control over these websites and is not responsible for their content or their privacy practices.

7. Personal data

7.1 Data controller

The publisher of the Website is the data controller for the personal data collected through the Website and can be contacted at contact@cm4dn.com. The publisher processes personal data in accordance with Thailand’s Personal Data Protection Act B.E. 2562 (2019) (“PDPA”) and, where it applies to visitors located in the European Union, the General Data Protection Regulation (“GDPR”).

7.2 Data collected

The publisher may collect the following data:

• Through the contact form and the availability alert form: name, email address, phone or WhatsApp number, desired check-in date and flexibility, and the content of your message.
• When you book an apartment: the identity details needed to prepare the rental agreement and to comply with Thai legal requirements, such as the notification of foreign residents to the Immigration Bureau (TM30), as well as payment information.
• Technical data: IP address, browser type and pages visited, as described in section 8.

7.3 Purposes and legal bases

Your data is used to:

• answer your questions and booking requests (steps taken at your request before entering into a contract);
• send you the availability alerts you have signed up for (your consent, which you can withdraw at any time);
• manage your booking and your stay (performance of the rental agreement);
• comply with legal obligations, including immigration notifications and accounting and tax requirements (legal obligation).

7.4 Recipients

Your data is only accessible to the publisher and the property manager, and to the service providers strictly necessary to run the Website and the rental activity (hosting provider, email service, payment providers). It may be disclosed to Thai authorities when required by law. Your data is never sold or rented to third parties.

Some of these service providers may be located outside Thailand or the European Union. In that case, the publisher ensures that appropriate safeguards are in place, as required by the PDPA and, where applicable, the GDPR.

7.5 Retention period

• Enquiries and availability alerts: until you unsubscribe or ask for deletion, and at most 24 months after your last contact.
• Booking data: for the duration of the rental agreement, then for the period required by applicable law (in particular 5 years for accounting records).

7.6 Your rights

You have the right to access, correct and delete your personal data, to object to or restrict its processing, to data portability, and to withdraw your consent at any time. To exercise these rights, contact contact@cm4dn.com. The publisher will respond within the time limits set by applicable law.

If you believe your rights have not been respected, you can lodge a complaint with Thailand’s Personal Data Protection Committee (PDPC) or, if you are located in the European Union, with the data protection authority of your country of residence (for example, the CNIL in France).

7.7 Security

The publisher takes reasonable technical and organisational measures to protect your personal data against loss, misuse and unauthorised access.

8. Cookies

The Website uses cookies that are strictly necessary for it to work properly.

It may also load content from third-party services, such as embedded YouTube videos, Google Maps, Google Fonts or social network links. These services may set their own cookies or collect your IP address when the content is displayed.

Where required by law, your consent is requested through a cookie banner before any non-essential cookie is placed. You can also manage or delete cookies at any time through your browser settings.

9. Governing law

This Legal Notice is governed by the laws of the Kingdom of Thailand. In the event of a dispute, the parties will first seek an amicable solution. Failing that, the courts of Chiang Mai, Thailand, will have jurisdiction, without prejudice to any mandatory consumer protection rules that may apply in your country of residence.
